Home appraisal

Can I sue my home appraiser? We were trying to get our home refinanced and had to have an appraiser to give the lender the home's value. We paid the appraiser at the door $400; however, when the appraisal came back a week later the home was valued $10,000 less than we paid for it two years previously. The appraisal had numerous errors on it. The square footage was incorrect he had it down for 2284 when actually it is 2664. He has it listed as a 4 bedroom when actually it is a five bedroom. In addition, under the previous sales he has it down as a previous foreclosure in 2007 (the MLS numbers are for a home that was built in 1991) and that our home previously sold for 84,000 and is on the market now for 114,000 when actually our home was built new in 2006 and we are the first owners of the home, it has never been foreclosed, and our home is not for sale. I have tried to contact the appraiser to get him to correct the errors; but he will not return my phone calls or emails. Our deal has fallen through. Can I sue him to get my money back or for fraud?

Yes you could sue but would probably not win..and it would cost at least $5000 to sue..

Well, you could possibly spend $5000 or more to hire a lawyer, but some people can present a case such as yours in small claims court and win. Good Luck.
