Legal Question in Consumer Law in Texas

Mercedes Extended Warranty

I recently traded in my Mercedes through a dealer. It had an extended warranty ($2300) but was still under the original manufaturers warranty. Prior to the transaction I asked the Mercedes dealer where I bough the warranty whether there was a surrender value to the extended warranty. I was told yes and asked to fill in a faxed form (I have a copy) and a refund Mercedes would be forthcoming. Several months passed, I eventually managed to contact the dealer again and was told that Mercedes extended waranties have no surrender value. I feel I have been been misled and a refund of $2000 played in my decision to trade the car rather than sell privately. Do I have a case against the dealer in small claims court? thanks

Re: Mercedes Extended Warranty

Sure. He may lie and say he didn't tell you it had a surrender value, but maybe a judge will believe you.
