Can't get title to car I bought

I bought an out-of-state car off of ebay from a private seller. I took out a loan on the vehicle and completely paid off the lien that the seller's bank had on it, and the rest went to the seller. My bank said they would send me the plates as soon as they got the title. Well now the seller's bank says they can't transfer the title because they only have an ''electronic copy'' and only the seller can get a hardcopy. But the seller won't return my phone calls or emails. Now I have a car w/ no title and no plates. Who is responsible for getting me the title? And is the next step to take legal action?

The seller is responsible for getting you the title. The seller's bank is responsible to release its lien - which they apparently did. You could sue the seller in Texas, get a Texas judgment and then seek to enforce it in the seller's state. Good Luck.

Right the seller is responsible, you could sue and wait. But as a practical matter..make friends with a local used car dealer..he can probably show you a short cut..or go to a new car dealer..they know more about titles than most of us lawyers...and there is normally a simpler adminstrative procedure..in Texas or wherever the seller lived...Good luck.

As both previous responses suggested, you can sue this seller in Texas and then go to enforce the judgment. There is an adminstrative procedure here in Texas that may be applicable to your specific situation.
