Legal Question in Credit and Debt Law in Texas

I have an account that has been sold to a collection agency. They have offered me a settlement amount. My overall credit rating is already considerably poor. What penalties would I incur if I didn't make pay this settlement? Could the collection agency send me to court for not paying the debt they have incurred? I assume my credit rating would drop.......but this account has been poor since 2004.

you may find the collection agency has no authority to take a lesser amount..if they sue, then defend on statute of limitations ie after 4 years and deny accuracy of the charges which probably includes upgraded interest and penalties..good luck
