debt collection suit filed against me

I have a school loan that I have been unable to pay due to unstable employment and lack of money. I am now unemployed and totally unable to make payments and they have filed a law suit against me. I have to file an answer in a few days and I am not sure what to do. I can't deny that I owe the debt; but, if I don't deny it, they can get a judgment against me. So, how do I respond so that I can get in front of a judge, explain the problem, and work something out? What do I say in my response?

The only answer would be to deny the debt. There's nothing that will get you "in front of a judge, explain the problem, and work something out". The legal system doesn't work that way. If you can, see if you can work something out with the creditor's attorney. Otherwise all you'd be doing is running up the attorney fees for which you'll ultimately be responsible.

If they won't work with you, simply let them know that you'll not fight it, but they won't be able to collect on their judgment, either.
