Old Debt in Texas

I have an old debt from Texas and was charged off in Texas. This was about 5 years ago. I know the SOL for credit card debt is 4 yrs in Texas, but I now have a infamous collection agency ( known for violating FDCP Act ) in VA trying to collect on the debt. I live in NY now and dont know if they realize the SOL is 4 yrs in TX and are going by NY SOL ...the debt was incurred in TX and should have TX SOL am I wrong on this instance? If I am right I am hiring legal representation I am tired of being harrassed and collection agencies taking advantage of consumer rights.

You may have a "conflict of laws" situation as to which state's SOL to use. That will ultimately be determined by the judge.

You will need a lawyer that's comfortable with the conflict of laws issue.
