Legal Question in Credit and Debt Law in Texas

We hired a web design company to create a custom website for our business. We are in Texas, the web design firm we hired is in Kentucky. We paid a 50% deposit up front and believe they breached the contract and did not continue to use their services. They are claiming we owe the additional 50%.

If we wanted to file suit for breach of contract, in what state would we file? The contract did state that it was subject to Kentucky laws. However, since I'm in Texas if we file suit in another state do we have to be there in person.

Sue them in Texas and see what happens. I'd argue that they crossed state lines to do business, so they're subject to the jurisdiction of the Texas courts (unless the contract specifically states otherwise).
