Legal Question in Credit and Debt Law in Texas

I was involved in a car accident 6 months ago. The other person was at fault. There insurance company paid for my car rempairs and rental. I recieved a check a few weeks after my car was repaired made out t me for $570 and on the check it said it was for riembursment for car loss. The first thing I did was call the rental company and they told me that everything was token care of. So I thought it was sent to me because my car was in the shop for 3 weeks. Now, 5 months later, that insurance companie is telling me that they sent me the check in error. They said they accidently sent me and the rental company a check. They called me a thief on the phone and then told my mother that she needed parenting classes for telling me that the check was mine, even though it was paid out to me. Do I have to give them the money back and can the sue me for this?

Base on your description, no error ..you were due the money and they could be liable for slander..
