Non-payment of funeral expenses

My girlfriend died last month. I placed a $2500 deposit to get her buried. 3 days later I lost my job. The funeral director now tells me that if I do not make payment in full in the next 60 days, they can exhume my girlfriend and move her to an indugent, county cemetary. Is this legal?
