Legal Question in Credit and Debt Law in Texas

I recently found out that my ex husbands wife has been reading my emails from my sons phone. She has also been using my social security number to check Texas' State Benefits Department (Food Stamps, Welfare, Medicaid)and see if I am receiving benefits. Is any of this legal and what can I do about it? She has also had a neighbor spying on me, submitted SEVERAL false reports to CPS, and spent the last two years spreading hateful stuff about me through text email and facebook. HELP? She also gave my social security number to a third party individual....

1. How do you prove it?

2. Go to the police and report identity theft. Keep your police report number. This is extremely important in building your identity theft file for future use. You need to go to all the agencies you mentioned above & report what is going on and get new accounts and new passwords.

If you can prove it, the District Attorney's office may prosecute her for identity theft. It is a criminal matter.

You might also have a civil matter against her. You will need to hire your own attorney to sue her personally for civilly. Please don't call me regarding this - I don't handle this type of case. I don't have anyone to refer you to since this is a very new type of law & very difficult to prove. I would look on www.avvo.com and see if you can find an attorney under consumer law.

3. Change all your accounts and passwords on EVERY account. Pick passwords using upper and lower case & numbers -- something very strange like -- PaSSwORd0012345789

4. The CPS reports are almost impossible to prove since CPS reports are anonymous.

5. Print out all the proof you have and keep it for at least 7 years.

6. If you can build a strong enough case, rarely Social Security will allow you to change your Social Security number. The TX Dept. of Motor Vehicles will also (rarely) change you driver's license number.

7. How can she check your emails from your son's phone. Why are your emails on your son's phone? This makes no sense to me.

You need to take steps to protect yourself.

You need to change your email address.

You need to delete your facebook account & get off facebook.

Yes, it's a pain.

But it eliminates her ability to access your information.
