Legal Question in Criminal Law in Texas

Animal cruelty?

My wife while driving received a call that her grandmother was in the hospital. Without thinking she rushed to the hospital with the kids, and our dog. They went into the hospital and let the dog in the car with the windows down. After 40 minutes, they came down to find the police and fire department there. They had gotten the dog out because someone had called them and told them about the dog. They open the door the dog runs away and has not been found! The kids are histericall not to mention my wife, the police do not arrest her, but say that charges are still pending. Yesterday we received a call from the detective on the case, and he stated it might be possible she get arrested for the charge of animal cruelty. He lost the dog, she was under stress because of her grandmother's condition, and the kids still cry for their dog. What to do?!?! I don't want my wife to get arrested. Please advise.

Re: Animal cruelty?

Do not have any more conversations with the police.

Hire a lawyer in your town to contact the police and determine their intentions. (Sometimes the best defense is a strong offense...)

If your family left the windows down, and the dog was not in stress or danger, your lawyer may want to consider publicity of this case.

Doubtful you will get compensated for your loss -- as falls within public duty.
