burglary of a vehicle
Can you plead no contest on a Class A misdemeanor? My brother has a warrent out for burglary of a vehicle. He lives in a different county now. Does he come back to the county of the incident to make a statement, or can he stay where he currently resides? Will his past record effect a possible decision if he goes to trial? Or if a judge imposses a sentence will he look at his past record? Thanks for your help.
Re: burglary of a vehicle
A person has the right to plead no contest -- it has the same legal effect in criminal law as a guilty plea. He doesn't need to be making any statements to anyone except his lawyer. If there is a warrant, then regardless of what he says he will be jailed. A past record is critical in sentencing. He needs a lawyer, before he does anything else.
