Legal Question in Criminal Law in Texas

Class C Assault

Please advise if a jail time could result from a Class C Assault going before a jury. This involved a minor stating that I touched him inappropiately. I know that I could be found guilty or not. If I were to be found guilty I've been told that they could then go after me for monetary compensation. If there is a guilty outcome, I'm not certain what may occur. Thank you

Re: Class C Assault

The range of punishment for a class c assault is fine only. You cannot go to jail. The burden of proof in a criminal case is beyond a reasonable doubt. The burden in a civil case is much less, a preponderance of the evidence. It is possible that the 'victim' could file civil litigation seeking money damages for the assault. He/she can do it whether or not you are convicted, but the odds of winning for him/her improve dramatically with a conviction.
