Legal Question in Criminal Law in Texas

My daughters dad has been in jail Since January 16th 2013. He has yet to go to court, as his date is reset every time. I do not know why it is always reset. Is this the lawyer asking for it to be reset? He was charged with DWI, avaiding arrest, and avaiding arrest with a vehicle. He also has priors and was still on parole. Is the laywer postponing it so that he stays in the county jail instead of going to a prison? Could he possibly be trying to get him a "time served"? I just don't understand why we are still waiting to find out how long he will be away. Is this a strategy or what could be going on? The lawyer never responds to any of our calls.

First, the lawyer need not respond to your calls because the lawyer does not represent you. If you want information on the case, you are expected to get it from the client. The lawyer does not have time to call every person who is curious about their client's cases.

It could be reset for a number of reasons including that the state has not made an offer because they are still gather evidence such as blood tests from the DWI, or they have complainants to talk with, etc. It could be reset because the lawyer is in trial in another case. It could be reset because your daughter's dad does not want to take the offer they have made and he just wants the case reset. It could be that your daughter's dad is waiting to see what parole says before making a decision on what he wants to do on the new charges. MANY reasons for resets.

Ask your daughter's dad why the case is being reset to get his version.
