Drug Charge
My brother, and 2 other individuals were caught with 150lbs of marijuana and they are in jail right now. My brother has been charged with possession of 50-2,000lbs. The driver signed an affidavit stating the marijuana was his. My brother has been in jail since 01/14/09 and I keep calling to check on his court date and they keep telling me the DA hasn't filed any cases on him yet? What does this mean? Is there a certain time limit the DA has to file a case? I'm hearing different stories. If the DA doesn't file in a certain amount of time should he be released. Is this true? He is in Denton County, Texas
