Expungement

On 5/20/2005 I was arrested for failure to signal lane change and no health insurence on my motorcycle (helmet law). I showed proof of insurence to the officer and the court and it was finally dissmissed. The lane change was deffered, however I still have an arrest on my record. I would like to have the arrest expunged. Can that be done without an attorny and if so what are the steps that need to be taken? I have no criminal record and no tickets on record.

A deferred adjudication will show on your record as an arrest and dismissed. The arrest is not allowed to be expunged by statute, however it you may be able to seal the record. Contact us if you need further assistance.

I am somewhat flabbergasted that you were arrested for a lane change violation and insurance issue. Expunction is usually done by attorneys, as the qualifications for obtaining an expunction can be complicated. Sometimes an expunction does not appear to be allowed by the statute, but if filed, the ADA will not oppose. It is filed in District Court. If you want to review it yourself, ask the librarian in the County Courthouse law library, as they usually keep sample pleadings. TCL
