Legal Question in Criminal Law in Texas

Misdemeanor & Felonies

How long does a misdemeanor class a, b, c stay on a person's background check? Does a person have to hire an attorney to get it expunged? Or does it come off automatically once the person completes probation?

How long do felonies stay on a person's background check.

Re: Misdemeanor & Felonies

You cannot expunge a class A or B straight probation nor a deferred adjudication from your record, and they will always be on your criminal record for the rest of your life. You might be elgible to file a petition for Non-disclosure, to have the record sealed depending upon the offense and depending the type of community supervision you receive. If, for example, it was a straight probation, you cannot have it sealed. You should also know that even if you are elgible to have it sealed, there are 23 agencies in Texas besides law enforcement that can still get ahold of the records even if they were sealed. You might be elgible to expunge a class C misdemeanor, but I would advise you to contact an attorney if you want it done correct, and I would advise you to contact a criminal defense attorney.
