penalties for accessary to forgery without knowledge

This is a first offense. My son was arrested with his so called friend who led him to believe his dad and him had an account together. He made out 3 checks to my son who cashed them because his friend had no ID. The friend had forged the checks. My son has been charged the same as his friend..what are the penalties.

It depends what was he charged with? Was it forgery? The felony of forgery carries a range of punishment starting at probation and running to 2 years in a state jail and a maximum fine of $10,000.

However, it sounds like your son may be not guilty.

What court is he in? When was he charged?

Forgery is a state jail felony. The range of punishment is from probation to 180 days to 2 years in the state jail and a fine not to exceed $10,000.00. Should your son be under 17 he is considered a juvenile under Texas law. Punishment is different under that system. If he is considered a juvenile please let me know and I will explain.

By the way, if your son's story is true he may not be guilty. The law provides that he do it "knowingly or intentionally." Ignorance of the law is no excuse but ignorance of facts may be.
