Legal Question in Criminal Law in Texas

Possession of Marijuana and Paraphernalia

In October of '98 my husband was arrested for possession of marijuana. No charges were made at that time. In April of 2000, my husband found out that there had been a warrant out for his arrest since December of '98. He got a lawyer, turned himself in at the end of May and thought he had taken care of everything. His license expired this past month and he was unable to renew it online. Come to find out there has been another warrant out for his arrest since June 2000. (the month after he turned himself in for the first one) This warrant was for the drug paraphernalia that was confiscated in '98. Why didn't the PODP come up when he turned himself in the first time? Is it just a coincidence that a warrant was put out for the PODP just days after he turned himself in for the POM?

Re: Possession of Marijuana and Paraphernalia

Look, you're dealing with government agencies who make and file charges, issue warrants, recall them, execute them, and the like. They don't always do good work. In fact, they screw up alot. You get what you vote for. I've had clients get arrested for not paying their fines, when in fact they had. I've had clients arrested on other people's warrants. I don't like it, but I didn't design this system. And it won't improve until we make our public servants liable for their negligence. Right now they're immune.
