Legal Question in Criminal Law in Texas

In the State of Texas if the legislature passes a law but does not put penalties into it when passed, can you be charged with a felony? I have heard that if there is no penalty written into the statue then the most you can be charged with is a Misdemeanor? Is this true?

If a criminal law passes, there are penalties assessed with it even it is by reference to a level only.
