Can I sue for merchandise paid for but not received, or what can I do?

I paid for a boat that was to be built. On Feb. 8 2007 I paid for the boat in full and was promised a boat in a shorter time period than if I were to just give half. Now it has been over 5 months and still no boat and all the explantion I can get is that he has no money to finish the boat. But he does have a new car, house,and 4 wheeler.

What are my options? Should I go pickup what he has, and seuw for the rest? Or do I try to seuw for the full amount plus lost revenue that I possibly would have made, and other expenses that I have had due to lack of contact on the builders part that otherwise would not have been spent if the boat were finished on time? I would really like to have the boat. I can't buy another for the $15200.00 that I paid.

What do you suggest?

There are a couple of options for you. The first question I have is whether you paid in cash or with a check. If you paid with a check, what is in the memo section. Probably won't be considered a criminal matter when it is a civil contract to build the boat. I recommend talking to Ryan B. Bormaster at my Firm.
