theft of service public transportation

what are the penalties if convicted of theft of service? the alleged theft concerns train fare. is this a traffic or criminal offense?

The offense will never be a traffic offense. However, depending on the amount of the train fair it could either be a Class C misdemeanor or maybe a class B misdemeanor. The value for a Class C misdemeanor theft is less than $50.00, if this is the case the punishment is a maximum of $500.00 plus any court cost, and no jail time. If the amount of the ticket is more than $50.00 but less than $500.00, the punishment can be incarceration in the county jail for any period of time up to 180 days, or a fine in an amount up to $2,000.00 or both jail time and fine. The value of the item or items always establishes the punishment.
