1st DWI...can I lose custody??

I got a Dwi in Feb. 2004. I have a suspended license now in Dec. 2008 for not paying the $1000.00 yearly surcharge. Am I considered an unfit parent and lose primary custody of my 5 year old son. I don't want to get an occupational license. Thank you

Custody is an issue that depends upon many factors, rarely only one.

If you have alternate arrangements for transporting your child when necessary, this should be a minor issue. If you have an alcohol problem that would be of greater concern to the court.
