Legal Question in DUI Law in Texas

Accused of DUI

My son was accused of DUI. He was out of the truck arguing with brother in carwash when police arrived. His friend drove him there and was out of the truck when police arrived. He says he tried to apologize and explain he was not driving but police just kept yellling at him to shut up and put his hands behind his back. His brother and friend say they could not speak up because they did not let them speak either. His friend was told that unless he wanted to be part of the arrest he'd better leave.

What or how can I proceded with this if I can't afford a lawyer? He has, in the past had a DUI.

There a lot of things a good DUI/DWI defense lawyer can do to win this case based on the fact pattern you have given.

First you need to know weather or not your son was charged with DWI or DUI because there is a difference.

With a DUI a minor has any detectable amount of alcohol in his body while operating a vehicle whereas a DWI one has lost the normal use of there mental and physical faculties by the ingestion of alcohol or drugs.
