Legal Question in DUI Law in Texas

Deferred Adjudication - DWI

I did the Parent taught drivers ed for my daughter to get her drivers lience and they told me that I couldn't do it because I had a DWI 20 years ago. I had deferred Adjudication and did my time with no problems and the case was dismissed. And that is what it shows on my record. Are they wrong to deni my daughters licience for this?

Texas DPS regulations provide that you would be denied if you ever had a conviction for DWI (including a probated sentence). You should get a certified copy of your record from the court indicating that you were NOT convicted, and contact Austin regarding the denial.

Re: Deferred Adjudication - DWI

Based on what you have written, it appears that your records in Austin are not accurately reflected by the court's disposition of your prior case. You might want to obtain a certified copy of your court documents and forward those certified records to Austin with a request for correction to your record. If my local law firm can assist you with this legal issue or any other legal matter, please contact my paralegal Tina ([email protected]) to arrange for an initial consultation.
