Being intoxicated in a parked vehicle

My son, 18yrs old, was recently charged with a DWI. He was defintely over the legal limit. He was arrested in the parking lot of a Whataburger. The car he was driving was in park, the engine was on. He fell asleep like this and was found by the officer. Was this the correct offense charged by the officer?
