Legal Question in DUI Law in Texas

I was in a minor accident ($1500 damage to my vehicle) with a man who ran through a 'left turn on green arrow only' light. The police came out, gave him a sobriety test---he told the officers he had 4 beers 4 hours earlier---but they did not give him a breathalizer; & subsequently let him go. I had no witnesses to the accident & the man is claiming that I ran a red light, which I did not, so now the insurance companies will not pay for my damages. Do I have any recourse against the police dept. for letting this man go? They also did not file an accident report, even though they had to do a sobriety test.
