Legal Question in DUI Law in Texas

On Sept 8 2010 my son was granted a Commerical Drivers License to drive back and forth to work. The hours and days of the week he was able to drive were clearly stated in the Order. The order also states he was able to drive to perform essitial House hold duties, so we did not list any times to perform those duties. My question is while at work he had to

go to the store to get a bite to eat and was on the way back to work when he was hit by a car while riding his Motorcycle. (the accident was not his fault and he was ok-)However the Round Rock Police Dept Still arrested him and he spent the night in Williamson Cty jail. Just wanted to know if going to the store is considered an essitial need?
