Legal Question in DUI Law in Texas

Son's Misdemeaner DWI conviction

My son is reticent about the penalties resulting from his conviction: probation for one year, fines, community service, etc. He's said something about going to jail instead. What are his options? He could lose his job, etc. Would jail time cancell out the other requirements. Would he be charged room and board. He is rather depressed at present and I worry about him making wrong decisions.

Re: Son's Misdemeaner DWI conviction

There is a nation-wide war on DWI. First offenders are promised fines, community service, drunk driving school, probation and other impacts.

It is possible to do jail time instead of community service, for example, but I don't know why anyone would want this option. The fines, court costs and screening programs are not avoided because one opts for jail time instead of community service.

The sentence imposed on your son is public knowledge and available to anyone. You can read the disposition from the court file at the clerk's office. Then you would know.

This should serve as a wake up call for your son as the second offense is dealt with much more harshly. Drinking and driving is a game the drive can't win.
