''Slander Suit & Breach of Contract''

Where would I start in filing a Slander Suit against a Promoter who has met with a Client who is under Management Contract with me?

Should I file a Breach of Contract Suit Against the Client for meeting with this Promoter after I had forwarded a proposal in the Clients behalf? The Client went behind my back to negotiate the Deal at the Promoters Negative statements about me.

You have not given enough information to show you would have any claim whatsoever against anyone. Unless it is an exclusive contract, and unless it was signed by the client, your client is probably free to talk to other reps. Slander?, I doubt it, unless you can show very convincingly that the other rep or client made deliberately false statements about you of an actionable nature. More probable is a possible tortious interference claim, but even there you have an uphill battle unless you have more than the conclusory generalizations you stated. Maybe it is as simple as that the other rep is just a better rep than you and the client chose to switch.

A couple of further thoughts. If you are talking about the client bypassing you despite your having an agency contract with him, then you complaint is against your client for breach of contract, assuming your contract actually prevents him dealing direct. The promoter is not under any contract with you, and slander suits are seldom successful in your sort of case. A tortious interference with contract suit, however, if the promoter knew he was inducing the client to breach a contract and if you have a pile of money to spend litigating,may be worth considering. If so, write and I can refer you to some Texas lawyers specializing in that sort of thing. It is too speculative to interest me, unless you have a lot more favorable facts than I think you do.

I would have to see the contract that you have in place with the person in breach before I could make the call about that. As for the person bad mouthing you, it depends on what was said and the veracity thereof. Additionally, we would have to show that the person relied on the false statement which in turn caused the breach.
