Legal Question in Family Law in Texas

My 17 yr old son has been living with my ex-husband since june. He went there because his dad said he could drive his car as long as he lived at his house. In Sept. he bought out son a new truck... I recieved papers today that he is sueing me for custody and modification of child support. We also have an 11 yr old girl that resides with me. I need forms to file my own petition and to state that I can't hire an attorney or pay his legal fees.

You need to file a document called "an Answer" to his lawsuit.

The child has lived with his Dad for 6 months so Dad has the legal right to ask for custody.

Since you both have a child, then child support should be reduced. Many judges will take what you should pay him and subtract what he should pay you. The difference goes to the party that makes less money. However, normally before you go to trial you will have to attend mediation.

Good luck!
