adoption with common law marriage?

My son is two and has never seen his real father. I have been with my fiancee since my son was two weeks old. We went to see a lawyer about adoption but the lawyer told us that we had to be married at least six months before we started the process. Does this mean legally married or is common law sufficient?

Actually, the child should live with the adoptive father in the home for six months, but this can be waived. The court will likely want to see an actual marriage before the adoption to be sure it is a "real" and stable long term relationship.
