Legal Question in Family Law in Texas

For years I have tried to find my childrens father.I have gone to oag more than 5 times and they tell me that he is no where to be found.He hasnt been in there lives for almost 7 years. Now that i am married my husband want to adopt then legally.Is there anything that we have to do to let that happen since the father has no legal right to them and hasnt paid me a dime. I tried to call all of his friends and they have all moved and there is nothing that i can do to contact them.

I'm sorry for your situation and what I have to tell you may not be what you want to hear. Even though he cannot be found, he is still entitled to legal notice of the adoption proceeding. This will require a Notice by Publication and the appointment by the court of an attorney to represent his interest even though he's a scumbag. Unfortunately, this will add to the expense of your adoption proceeding. I don't know what the additional expense might be, but in Houston, the notice costs aabout $400 and the attorney is about $750. This would be in addition to the fee arrangement with your attorney. Could total $3,000-$4,000 maybe slightly more depending upon the rates in San Patricio County. If you contact me by email, I can discuss my legal fees with you.
