Adults dating minors

My daughter (soon to be 16) is dating a boy who turned 18 two weeks ago. His parents do not want them to date any longer because they are afraid that he will go to jail. It is my understanding that since they are not 3 years apart in age it is not a problem as long as I give my permission. (They are 2 years and 4 months apart) Is that correct?

It's not a problem as long as there is no sexual activity -- none, nada, zippo, zero. If that is a problem, it's his problem and he can take care of that.
