Legal Question in Family Law in Texas

my boyfriend and his ex have a baby together. she is going to court for having an illegal substance in her car, if she gets convicted what is the possibilty of my boyfriend getting to keep his son?

It depends on a number of things. Does HE have any drug record or history? What was the controlled substance? How old is the child and how regularly has he exercised possession? Are there any other issues in EITHER parent's past that would affect a judge's decision?
