Legal Question in Family Law in Texas

Is this breaking a contract and if so.....

I have joint custody of my son with my exGIRLFRIEND. On our custody papers it specifies that my son has to go to a certain school until the eighth grade....we both pay half of his school and supplies etc,. The exGIRLFRIEND lost her job and may not want to send him to that school because she can't afford it. Is this breaking a contract and what can I do?

The paperwork says if she can't pay....I will have to pay and have her pay me back....and what if she doesn't pay me back...can or should I sue her for the school tuition?

Any info. is helpful here in San Antonio

In short, she is violating a court order, and you can petition the court for enforcement -- to pay the school or reimburse you.
