Name change
I have a 12 year old son. His father and I were never married, but he signed a petition of parental rights and birth certificate. My son carries his last name. But, when my son was 1 1/2 years old, his dad has been in prison. Can I as the mother change his name? My son has been asking to change his last name.

With the father's permission, or file your motions and serve the father if he defaults you may get what you want.
