Legal Question in Family Law in Texas

a child was born 11yrs ago while i was incarcerated in TDC, no ackwoledgment of paternity was signed and i wasent put on a birthcertificate as the father, was told by the mother i have no rights to the child, now 11yrs later i think she filed for assistance (tanf) and i got a letter in the mail from the OAG trying to resolve before taken to court. not sure what to do, i am a unemployed felon recieving goverment assistance, with 2 other children to take care of. is this legal? can she hold me responsible if she knowingly kept me out of the childs life for 11yrs? and in that time she has signed rights back and forth with her mother whenever she goes to jail for drug offences..is this legal without my permission as well? no paternity test has ever been established. thank you for your time.

The letter from the OAG is a valid means to resolve the problem without litigation. It is a Child Support Review Hearing held in the OAG offices. At that time you can request DNA testing, and the meeting will be reset when the results come back. If you are the dad, you can then negotiate the amount of support, possession and access. Ideally, you should have a lawyer, but the review meeting is fairly straightforward.
