child custody

my sis inlaw left my brother and son dec 26, 2006. reason being, she just doesn't love him anymore. Can she take away my nephew when ever she decides that she wants him living with her?

If your brother has custody of his child, she can always come back into court and ask for a modification.

The burden would be on her to prove why this would be a good thing for the child.

Once the child turns 12, he can sign a statement about who he wants to live with primarily, but IT IS NOT binding on the Judge.
