Child Custody

I have my son living with me during the school year. His mom sent him to me because he was not acting right. Now she wants to take him on a vacation during the school week. I have told her no. She now wants to come get him to take him back to live with her. Is there any way I can fight this, since he is enrolled in school and living in Texas with me and no longer in OKLA? Please help and advise.

If the last order related to the child was entered by an Oklahoma court, you need a certified copy of that order as a first step. If the child has lived with you for more than 6 months, file suit on behalf of the child in the county where you live. The suit will ask that the Oklahoma order be registered and that the Texas court modify it concerning custody.

The mother may file suit in Oklahoma and, if so, you will need to defend that suit as well as pursue the Texas suit.
