child support

i pay child support and it just increased with out me getting any information before hand. the reason i noticed is because it comes out of my check every payday. i thought that i would have to go back to court if he wanted more money, can the state just increase my payments with out notice?

Generally, a suit for modification would have to be filed and you would have to be served. since you have a withholding order,there can be no question but that you are able to be located.

There are exception, such as when the withholding order provides for increased payments due to some foreseen event, but those are rare.

Contact an attorney to evaluate this. Take him or her all documents that you have concerning this. If a proper petition was not filed, then you might not be subject to pay increased support prior to the date of service.
