child visitation

The question i have is if the non custodial parent is not picking up the child on scheduled days can visitation be modified?? Also my 12yr old son is refusing to visit with his father on his scheduled days. He cries its an emotional strain on him every other weekend is this cause for visitation modification.

Remember that the Standard Visitation Schedule is a fall-back for parties who cannot agree otherwise. The courts much prefer parents to find visitation solutions that conform to their lifestyles. Try to reach a modified schedule on your own. If you can't, any family law attorney would be happy to accept your money to help you resolve the issue. A child's reluctance to visit a parent is not grounds for modification. If the court ordered it, the presumption is that it is in the child's best interest.
