Common Law Marriage And Divorce

My brother has lived with a woman for the past 6 years. They bought a house together several years ago, but have no other shared bills. They have recently broken up; he was told that in order to make everthing legal between the two of them, he would have to get a divorce, even though they were never legally married. Is this true? If so, how does he go about obtaining this divorce? He was also told that if he actually were to marry someone else, he could be charged with bigamy. Is this true?

Common law marriage is a claim that could be made, but that depends upon more factors than just the purchase of property together. Your inquiry doesn't contain enough information to determine whether or not they were common law married. Your brother would be best advised to discuss this with an attorney or if an attorney has advised him to obtain a divorce, he could always speak with a specialist in Family Law.
