Can you have a common law marriage while going through a divorce from an ordinary marriage?

No. You can only have one marriage in effect at a time. If you meet the elements of a "common law marriage" (which is more properly referred to as an "informal marriage" in Texas), then that informal marriage springs to life once the formal marriage is dissolved by divorce, annulment, or death.
