Legal Question in Family Law in Texas

Custody of Niece

I have been given guardianship of my 13 year old niece by her father 10 months ago. I live in Texas. She formerly lived in Oklahoma. Her mother passed away when she was 3. Her father is not parenting material, has two warrants for his arrest and is basically a drifter. Her 18 year old sister wants her to come live with her. She can't even take care of herself. Because of this, I want to seek custody of my niece. What rights do I have and what are the chances of me gaining custody of her? Also, would this case be heard in Texas where she currently lives with me? Or in Oklahoma where her father ''claims'' to live?
