I want to get divorced from my husband of 9 years. He has threatened to take our truck away and we live with my Dad because of Hurricane Ike. Now I am wanting to know, Can he legally take away the truck which I need for our disabled 11 year old daughter and can I kick him out of the house even though it is my Dad's?

The division of property, and child support obligations can be determined at the temporary orders hearing. You will need to file for divorce, have him served, and request a temporary orders hearing. Your situation is not a simple DIY, and you should retain an attorney to handle it for you. If you are unable to afford counsel, contact the State Bar, and there was a system set up for people displaced by the hurricanes.
