divorce
i have filed for divorce, originally were married, divorced and have lived together for 17 years. the soon to be ex-husband denied common law marriage in beginning, and now he is saying well maybe we were married because he doesn't want me to get any of his retirement, 401 or alimony. Is there a problem here first he claims we weren't married and now he says yes we were common law. What is my advantage here

Common law is something that has to be proven and can be denied by your husband. You better talk to a lawyer if you want those things. Otherwise, you stand a good chance of losing. Remember this - from now on never deny that you considered yourself to be married.
