My divorce has not been finalized yet, my wife and kids are living with her boyfriend and my 5 yr old son and 7 yr old daughter both said they were spanked by the boyfriend. Can he do this legally?

Here's an idea: Insist on a provision in your decree that says "Neither parent shall allow the children to be physically punished by a non-parent at any time."
