Legal Question in Family Law in Texas
Divorce and Remarriage
I am currently going thur a divorce in Texas and my husband told me that he is going to put in our papers that I can not move out of our current county, nor can I (at a time down the road) have over night guests of the opposite sex while I have our child (I have primary custody) and that that means I will not be able to remarry until she is 18 or not living with me. Can this stipulation be approved? Does the court have the power/right to dictate a persons future?
Thanks

Re: Divorce and Remarriage
The court may consider that it is in the best interest of the child to have her father nearby for support and visitation. He would have to prove that this is a good idea. As for your sleep over plans, some judges consider that adult activities are OK between adults, but not to be observed by children. We all know that the kids see much worse on TV and movies, but it's a little different when children wake up a stranger in the house.
Re: Divorce and Remarriage
What your husband is confused about is that you can BOTH be restricted to no overnight guests of the opposite sex. This is normally agreed to by the parties. Many judges won't order it.
However, if you get married, the person is then your "husband" and not an unrelated person of the opposite sex.
He can't prevent you from re-marriage.
However, if you marry a registered sex offender you are required to give him notice. So don't marry a registered sex offender.
How do you know, check out one of the registered sex offender websites available for free on the net.
