Legal Question in Family Law in Texas

getting a divorce. My wife has her own business but doesn't make ask much as I do. She want half of everything, plus she want the house and spousal support. But I only want my house and car, because I works out of my house. Will the judge grant her all this and give me nothing because I make more then her.

She can ask for "the moon" but only a judge can decide what is fair.

I cannot tell where you live in Texas. Many courts order people to mediation before they have a trial. In reality, over 90% of all family law cases are resolved before trial.

You need to hire an attorney immediately. Look on this website & on www.avvo.com for a family law attorney.

Basically, the judge puts all assets on the table and tries the divide things equally unless one of you have pled for more than 50%.

If you cannot agree on the house, the judge can order it sold if it is community property. I highly advise that you don't allow a receiver to be appointed to sell your home since it will probably sell well below market value.

I cannot tell if she is entitled to spousal support. The attorney will ask you a bunch of questions to determine if this is even an option for her.
